What Happens Next?

  • We will promptly remove or disable access to the allegedly infringing material upon receiving a valid DMCA notice.
  • We will notify the user who posted the content and provide them with a copy of the DMCA notice.
  • If the user believes the content was removed in error, they may submit a counter-notification as outlined below.

Counter-Notification Process

If you believe your content was removed in error, you may submit a counter-notification to our Copyright Agent. Your counter-notification must include:

  1. Your contact information.
  2. Identification of the removed material and its location before removal.
  3. A statement under penalty of perjury that the material was removed due to a mistake or misidentification.
  4. Your consent to the jurisdiction of a federal court in your area (if in the U.S.) and acceptance of service of process from the notifying party.
  5. Your physical or electronic signature.

Upon receiving a valid counter-notification, we may restore the removed material within 10-14 business days unless the copyright owner files a legal action.

EightSleepNight.com reserves the right to terminate the accounts of users who are repeat infringers of intellectual property rights.
